La jurisdicción voluntaria ha sido considerada invariablemente un capítulo del derecho procesal; es nuestro deber precisar este aserto. Sin duda que denotar un concepto claro y distinto de lo que constituye la jurisdicción voluntaria en tanto su naturaleza sea jurisdiccional -criterio que no compartimos- lo es.

Estos principios resultan explícita o implícitamente de las conclusiones a que han llegado los Congresos celebrados por la Unión desde su fundación hasta nuestros días, cuando se han ocupado de temas relacionados con el Notariado, la función notarial o el instrumento público.
