El notariado actual, de tipo latino, en México y en los demás países de iguales raíces jurídicas, tiene ya una duración de siglos. No nace por decreto oficial, sino que es producto de la realidad, de la vida misma; surge ya con rasgos definidos en las ciudades italianas del siglo XII, se desarrolla y se extiende a todos los países europeos y luego a los americanos que reciben el Derecho Romano, con la natural evolución y adaptación a los nuevos tiempos, pero respetando siempre unos rasgos fundamentales. En este sentido puede decirse que el notariado es una institución permanente, tradicional.
