La sucesión testamentaria históricamente se ha sujetado a la voluntad expresa del titular, por medio del testamento agrario, y la sucesión legítima surge cuando no existe aquel, o los sucesores designados están imposibilitados material o legalmente, y en tal supuesto, la adjudicación de esos derechos se rige por el orden de preferencia establecido por las diversas legislaciones agrarias que a continuación describo para conocer su evolución.
