La manifestación de voluntad expresada a fin de concretar un acuerdo de voluntades o negocio jurídico, puede ser transmitida por medios naturales (por ejemplo, la voz), o por medios técnicos (la tinta y el papel).- Con la aparición de la informática y los Modernos medios de comunicación, esta manifestación de voluntad puede transmitirse a través de los mismos.- El problema en el mundo jurídico ha sido, tradicionalmente, la prueba de los acuerdos o contras.- La historia del derecho recoge la utilización de diversos medios de prueba tales como testigos y la prueba escrita.- En la transmisión e acuerdos por fax o módem, las constancias resultantes no son suficientes para otorgar fuerza probatoria a la manifestación de voluntad así transmitida.- Encontrar una solución conforme derecho vigente: es la tarea de los juristas.-
